Measures of state control over the use of the state language by the education department of the Berehivska district state administration, conducted at the end of 2022 following the Commissioner's decision, revealed certain shortcomings and violations of the current legislation.

In particular, in most of the 108 schools of the Berehiv district of Transcarpathia, there are classes with the Hungarian language of instruction along with the state language, but in 37 of them, none of a single class has been formed in which the teaching would take place only in the state language.

To note, the current legislation does not provide for the functioning of educational institutions with instruction in the language of the national minority. Instead, the law requires the creation of separate classes (groups) with instruction in the language of the respective national minority along with the state language. At the same time, in such classes, the scope of study time for subjects studied in the state language should gradually increase from 20% in the 5th grade to 60% in high school.

At the same time, contrary to the legislation, the official full titles of 4 schools, operating in Berehiv district (Koson village council), contain the formulation "with the Hungarian language of instruction". In particular, we are talking about Popivsk gymnasium, Rafainivsk gymnasium, Shomivsk gymnasium, Zapsonsk gymnasium.

It was also searched that the educational programs and curricula of all schools in the district, in which classes are taught in the Hungarian language alongside the state language, do not specify the language of subject’s teaching. Such a situation may lead to other violations. So, for example, the management of Vynogradivsk General Education School named after Zygmond Pereni reported that in all classes subjects were taught simultaneously in two languages: 70% in Hungarian, and 30% in Ukrainian. This form of education contradicts the current legislation, in particular, the provisions of part six of Article 5 of the Law of Ukraine "On Comprehensive General Secondary Education".

During the implementation of state control, it was also found that in some acts of the Ministry of Education and Science of Ukraine, contrary to the legislation, the definition of "school with the Hungarian language of instruction" is applied. This creates grounds for general secondary education institutions to violate the norms of the legislation on the state language and may result in the process of segregation of students, who represent the national minority of Ukraine, from communication with other children. The impossibility of mastering the Ukrainian language in accordance with educational standards will slow down the full integration of education seekers into Ukrainian society.

Based on the results of state control, a relevant act was drawn up with recommendations to eliminate the identified deficiencies. It was sent to the address of the Berehiv District State Administration. Also, the relevant appeals of the Commissioner were directed to the Ministry of Education and Science of Ukraine, the Committee of the Verkhovna Rada of Ukraine on Education, Science, and Innovations.

"I will continue to take control measures regarding the observance of language legislation by educational institutions," the State Language Protection Commissioner said.

"Issues related to the violation of the rights of Ukrainian citizens to receive information and services in the state language are always under my control," he emphasized. - The Ukrainian language is a guarantee of strengthening the state unity of Ukraine!"
